​Deste número da Newsletter de dezembro da EBLIDA destacamos a Reforma da Diretiva Europeia e do Regulamento sobre a proteção das pessoas singulares no que respeita ao tratamento de dados pessoais e sua livre circulação. 

A Diretiva deverá ser transposta para as legislações nacionais até ao dia 6 de maio de 2018 e o Regulamento será aplicado a todos os Estados Membros a partir do dia 25 de maio.

A este propósito, e no que respeita às bibliotecas como entidades que disponibilizam o acesso a informação que contém dados pessoais, na maioria das vezes embebidos em documentação digitalizada, Jerker Rydén, advogado da Biblioteca Nacional da Suécia, alerta para a necessidade das legislações nacionais considerarem esta problemática, nomeadamente no que se refere ao estabelecido no Artigo 9º do Regulamento.

Deixamos aqui um excerto dessa advertência:

“Libraries administrate collections, which include the special categories of personal data referred to in article 9. It is furthermore impossible to extract such data and block access to the data with 100-percent certainty. And even if it would be possible it is not desirable. Source material should not be corrupted. For that reason the only possible way to provide libraries with the legal underpinning to the processing of special categories of personal data referred to in Article 9 of the regulation is for MS to introduce supplementary national legislation which “shall be proportionate to the aim pursued, respect the essence of the right to data protection and provide for suitable and specific measures to safeguard the fundamental rights and the interests of the data subject.” (Article 9 g). Considering the timeframe referred to above, there is an urgent need for libraries to get engaged on national level and lobby for Member State law to be enacted in due time for the Regulation to be applied, May 25th 2018. Such legal underpinning for the processing of data is therefore crucial for libraries to uphold their digital services from May 25th 2018 and beyond.”
